Discuss Insurance Interest of Marine Insurance
[内容摘要] 海上保险是一种古老的保险制度，可保利益在海上保险制度中扮演着重要的角色，它是构成海上保险合同的主要条件。可保利益这一概念最早是在《1746年英国海上保险法》中出现的，而当时的学者将可保利益仅仅视为所有权。随着海上保险制度的发展，这种朴素认识的狭隘性很明显地显现出来。本文将从海上保险的保险标的与可保利益，海上保险可保利益的定义、构成要件和作用，主要的海上保险可保利益以及具有海上保险可保利益的时间几个方面对海上保险的可保利益这一问题作简单论述。
[Abstract] Marine Insurance is an ancient system of Insurance,Insurable Interest,constituting the main condition of the contract of Marine Insurance.The concept-Marine Insurance,was originally found in “Marine Insurance Act 1746”.And,the scholars at that time merely viewed it as Title.Then,with the development of the system of Marine Insurance,This marrow and limited knowledge prominently showed up.In this article multiple questions regarding the dedfinition,constitutional condition and function of Subject Matter of Insurance,Insurable Interest and Insurable Interest In Marine Insurance will be simply covered.Besides,certain&nb sp;points will be also futher introduced,such as the main Insurable Interest in Marine Insurance and the time concerning the Insurable Interest in Marine Insurance.
